LEGAL
Terms of Use
Effective date: September 5th, 2026
Last updated: September 5th, 2026
These Terms of Use (“Terms”) apply to theosterlingbooks.com and the pages and features that link to these Terms (collectively, the “Site”). The Site is operated by the individual author publishing as Theo Sterling (“Theo Sterling,” “we,” “us,” or “our”).
By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. About the Site
The Site provides information about Theo Sterling, books, fictional worlds, reader resources, newsletters, surveys, and related projects. The Site may also link to retailers and other third-party services.
Theo Sterling does not sell books or process payments through the Site. If you follow a link to Amazon or another retailer, that retailer independently handles the visit, purchase, payment, delivery, returns, and customer service under its own terms.
2. Privacy
Our Privacy Policy explains how we collect, use, disclose, and protect personal information. It also describes the choices available to you.
3. Ownership and Permitted Use
Unless otherwise stated, the Site and its original text, artwork, graphics, logos, fictional material, downloads, and other content are owned by Theo Sterling or used with permission. They are protected by applicable copyright, trademark, and other intellectual-property laws.
You may access the Site and download materials that we expressly make available for your personal, noncommercial use. This limited permission does not transfer ownership to you.
Except as permitted by applicable law or with prior written permission, you may not:
- reproduce, republish, distribute, sell, license, or publicly display Site content;
- modify Site content or create derivative works from it;
- remove copyright, trademark, attribution, or other rights notices;
- use Site content to train, develop, or improve an artificial-intelligence or machine-learning system; or
- systematically scrape, harvest, extract, or compile Site content or data.
These restrictions do not prohibit normal use of a web browser, sharing an ordinary link to a public Site page, lawful quotation or fair use, or indexing by a public search engine that follows the Site’s technical instructions.
If material on the Site belongs to someone else, that owner’s rights remain with that owner.
4. Acceptable Use
You may not use the Site to:
- violate a law or another person’s rights;
- submit unlawful, infringing, fraudulent, threatening, abusive, or malicious material;
- impersonate another person or misrepresent your identity or affiliation;
- introduce malware or interfere with the Site’s security, availability, or operation;
- bypass access restrictions or probe the Site for vulnerabilities without authorization;
- collect information about other visitors; or
- use automated systems in a way that places an unreasonable load on the Site.
5. Messages, Surveys, and Other Submissions
You may send messages through the contact form or voluntarily respond to surveys. You retain any rights you hold in material you submit.
You give Theo Sterling permission to receive, store, review, reproduce, and use your submission only as reasonably necessary to respond to you, operate the Site, conduct the research described with a survey, enforce these Terms, or comply with law. Our handling of personal information is governed by the Privacy Policy.
Do not submit material you do not have the right to provide. Do not send confidential information, unpublished manuscripts, story pitches, or other creative ideas unless Theo Sterling has specifically agreed in writing to receive them. An unsolicited submission does not create a confidential, fiduciary, employment, representation, or compensation relationship.
6. Mailing List and Free Reader Resources
Mailing-list signup is voluntary and uses email confirmation. You may unsubscribe through the link in any marketing email.
A free reader resource offered for signup is licensed to the recipient for personal, noncommercial use unless the resource says otherwise. It may not be sold, publicly posted, or redistributed without permission. We may change or discontinue a resource or mailing-list feature, but doing so does not affect your right to unsubscribe.
7. Third-Party Services and Links
The Site may link to or use services operated by others, including Amazon, Payhip, Brevo, Google, Meta, and hCaptcha. Their services are governed by their own terms and policies. A link does not make Theo Sterling responsible for a third party’s content, availability, security, privacy practices, products, or services.
You should review the destination’s terms and policies before using a third-party service or completing a transaction. Any dispute about a purchase made after leaving the Site must be addressed with the retailer that handled the transaction.
8. Availability and Changes to the Site
We may correct, update, remove, suspend, or discontinue Site content or features at any time. We do not promise that every page, link, download, or feature will always be available or free from errors.
Book descriptions, release plans, availability, prices shown by retailers, and other project information may change. Retailer information controls for a transaction completed through that retailer.
9. Disclaimers
To the fullest extent permitted by applicable law, the Site and its content are provided “as is” and “as available.” Theo Sterling disclaims warranties that the Site will be uninterrupted, error-free, secure, or suitable for a particular purpose.
Nothing in these Terms excludes a warranty, right, or remedy that applicable law does not allow us to exclude.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Theo Sterling will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, revenue, profits, or opportunities, arising from or related to your use of or inability to use the Site or a third-party service linked from it.
Where liability cannot lawfully be excluded, it is limited to the minimum amount permitted by applicable law. These limitations do not apply where applicable law prohibits them.
11. Suspension or Termination
We may restrict or terminate access to the Site when reasonably necessary to protect the Site, enforce these Terms, comply with law, or address misuse. The provisions concerning ownership, submissions, disclaimers, liability, and disputes continue to apply after access ends to the extent relevant.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-law rules. This choice does not deprive you of any protection that cannot lawfully be waived under otherwise applicable law.
Before filing a claim, you and Theo Sterling agree to make a reasonable effort to resolve the dispute informally by email. Nothing in this section restricts either party from bringing a claim in a court that has jurisdiction under applicable law or from seeking urgent relief when reasonably necessary to protect rights or safety.
13. Changes to These Terms
We may update these Terms to reflect changes to the Site, our practices, or applicable law. The revised Terms will be posted on this page with a new “Last updated” date. Changes apply prospectively from the stated effective date unless applicable law requires otherwise.
14. Severability and No Waiver
If a provision of these Terms is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law. A failure to enforce a provision is not a waiver of the right to enforce it later.
